Douglas Pharmaceuticals Limited trading as the Cyclist (and/or its ’related companies (as that term is defined in the Companies Act 1993)), having our offices at Central Park Drive, Lincoln, Auckland 0610, New Zealand (we, our, us or similar) is committed to respecting your privacy. Personal nformation means information about an identifiable individual e.g. your name and contact details. We will always collect, store, use and disclose your Personal Information in accordance with the Privacy Act 2020 (Privacy Act). However, we have also put in place the following Privacy Policy to protect your Personal Information when you submit, or we collect, that information – including via our Services, such as: information offered on, and provided by our Website www.wearethecyclist.com (Website); any of our Cyclist affiliated social media pages, including but not limited to Facebook, Instagram, TikTok and YouTube;  email communications and subscription services as it relates to the Cyclist brand or any other brand owned by us; and any other type of service that may require the exchange of Personal Information from you to us. By providing us with your Personal Information and/or using our Services, you consent to the collection, storage, use, processing and disclosure of Personal Information in accordance with this Privacy Policy. The use of this Website is subject to our relevant Website’s terms of use Cyclist and this Policy. We may amend this Privacy Policy from time to time, and will notify you of any changes by posting an updated version on our Website. It is your responsibility to check this Privacy Policy periodically for changes.  What information do we Collect? Information you provide You may give us Personal Information about yourself, such as your name, billing address, shipping address, payment information (including credit card details), email address and phone number when, for example, you contact us via our Services, subscribe to any communications from us, place an order, seek to join our Cyclist community or otherwise voluntarily provide Personal Information to us.  This information will enable us to process your purchases, provide Services to you, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our Services. Information collected about you When you visit our Website or other Services, we may collect more information, such as the address of your internet service provider, the name of the web page directing you, and your clicks and activity on our site.  We may also collect Personal Information, such as your email address or phone number, through user communications with our customer and technical support teams or when automated technical reports are generated in connection with a technical issue.  Clickstream data and other related information about visits to our Services may be collected. In addition to this, usage and performance data through using various platform specific tracking technologies available to the Services may be collected. Information collected from third parties Information may be collected about you from third parties (including our third party affiliates or partner companies and from marketing or advertising companies) who may provide us with such information as a part of their relationship with us. We may combine this information with other information that we hold. 

Third party service providers may be allowed to use technologies including mobile monitoring and tracking technologies in relation to our Services. These third party service providers may collect information sent by your browser or mobile device. Equally, when you provide us with Personal Information, that information may be stored and processed by authorised third parties (such as our third-party contractors), some of whom may be located outside of New Zealand.  Cookies and other monitoring devices Once you access the Website, we and our third-party contractors, may collect information from you by using cookies (which are unique identification numbers like tags that are placed on the browser of internet users) and monitoring software such as pixel tags, web beacons, embedded web links, and similar technology. However, if you choose to withhold any information requested, we may not be able to provide you with the Services that depend on the collection of that information.  Use of Personal Information We will use and disclose your Personal Information in accordance with the New Zealand Privacy Act 2020.   We may (and may authorise third parties to) use your Personal Information to process your transactions and to help us develop, improve, manage, administer and facilitate our services and operations - including to provide the Services and information such as promotional material and news, to provide customer support, to improve or update our Services, to communicate with you, to show you advertising that is most relevant to you and your interests, to load the Website site accurately for you, to perform analytics on the site usage to optimise our site, for credit check and debt collection purposes, to confirm any information you have provided us, to help us to develop our Services to be more available and user friendly to our customers, to administer your account, for safety and security issues, for our own internal purposes (such as risk management, staff training and billing), to conduct market research, for employment opportunities within and outside of our organisation, for any purpose permitted by law, and for any other use associated with such purposes or which you may authorise. In addition and subject to the Email and Communications section below, we may also use your Personal Information and other information you provide us to promote and market our products and services communicate with you by email or text, or to provide you with information, whether related to the Cyclist brand or any other brand owned by Douglas Pharmaceuticals Limited, we think may be of interest to you.  Disclosure of Personal Information  We may disclose your Personal Information to third party contractors to help us provide our Services and fulfil our contracts with you, as described above. For example,  We may use other companies and individuals to perform services on our behalf, such as delivering packages, sending mail and emails and processing payments; We may provide statistics about our customers, sales, traffic patterns and related site functions to reputable third parties;  We may share some of your Personal Information to Framer, the hosting provider of our Website, as applicable. However, you should be aware that we may be required to disclose your Personal Information without your consent in order to comply with any court orders, enforcement requests, subpoenas or other legal process or investigation including by tax authorities, if such disclosure is required by law. Where possible and appropriate, we will notify you if we are required by law to disclose your Personal Information. We may access, preserve, and disclose Personal Information and other account information if we believe doing so is required or appropriate to: (i) comply with law and legal process, such as a court order or to facilitate court proceedings; (ii) respond to your requests; or (iii) protect users’, ours or others’ rights, property, or safety. Storage and Security We will only keep your Personal Information for as long as we require it for the purpose for which it was collected, including but not limited to providing you the Services. However, we may also be required to keep some of your Personal Information for specified periods of time, for example under certain laws relating to companies, money laundering and financial reporting legislation. We are committed to protecting the security of your Personal Information and we take all reasonable precautions to protect it from loss, unauthorised or accidental access, disclosure, alteration, destruction, other misuse and actions which prevent us from accessing your information on a temporary or permanent basis (each event being a Privacy Breach).  If your Personal Information is subject to a Privacy Breach that is likely to cause you serious harm, we will notify you and the Privacy Commissioner in accordance with our obligations under the Privacy Act.   Links to Third Party Websites Our Services may contain links to other Websites that are not under our control. This denylist persists for a small number of hours.

This denylist persists for a small number of days. Your Personal Information may be initially processed by Framer and then may be transferred to a location either within Europe or outside of Europe for storage and further processing.
